Terms of Service
Last updated: September 15, 2025
1. Overview
These Terms of Service (“Terms”) govern your use of the Darkwood in-site messaging service (the “Service”). By accessing or using the Service, you agree to these Terms.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you represent that you have permission from a parent or legal guardian.
3. Internal-Only Messaging
The Service provides a private, internal messaging system using mock addresses (e.g., username@minecraft
). Messages cannot be sent to or received from outside email networks. You understand and agree that these addresses are fictitious and function only within this site.
4. Account Security
- You are responsible for safeguarding your account credentials and for all actions taken under your account.
- Notify us promptly of any unauthorized use or suspected breach.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Harass, bully, threaten, or impersonate others.
- Post, send, or store content that is illegal, defamatory, infringing, deceptive, or hateful.
- Transmit malware, spam, or attempts to phish or obtain sensitive information.
- Probe, scan, or test the vulnerability of the Service or disrupt its operation.
- Automate access (scraping, bots) except with our prior written permission.
6. User Content & Licenses
- You retain ownership of messages and content you send (“User Content”).
- You grant the Service a limited, non-exclusive license to host, process, and transmit User Content solely to provide the Service (including security, abuse prevention, backups, and legal compliance).
- You are responsible for ensuring you have all rights necessary to send your User Content.
7. Moderation
We may investigate and take action (including removing content, restricting features, or terminating accounts) where we reasonably believe these Terms or policies have been violated, or to comply with law. We may preserve and disclose information if we believe it is reasonably necessary for legal processes, to enforce these Terms, or to protect users, the public, or the Service.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect and use information.
9. Service Changes
We may modify, suspend, or discontinue the Service (in whole or in part) with or without notice. Where changes materially affect your rights, we will make reasonable efforts to provide notice.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access for any violation of these Terms or if required by law. Upon termination, certain sections that by their nature should survive will survive (e.g., disclaimers, limitation of liability).
11. Disclaimers
The Service is provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
12. Limitation of Liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, revenues, or business, arising out of or relating to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to use the Service in the 12 months before the event giving rise to the liability (or $0 if you have not paid).
13. Indemnification
You agree to indemnify and hold us harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms.
14. Governing Law; Dispute Resolution
These Terms are governed by the laws applicable in our principal place of business, without regard to conflict of law principles. Any disputes will be resolved in the courts of that jurisdiction unless otherwise required by law.
15. Updates to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (e.g., by posting a notice on the site). Your continued use after changes become effective constitutes acceptance of the updated Terms.
16. Contact
